Offshore: Investigating Complex Foreign Finances

This presentation will cover the most complex ways of moving funds offshore to foreign locations, bank accounts, and entities. Moving money to offshore locations is a common form of disguising the source, origin, destination, or purpose of fraud schemes, money laundering, terrorist financing, and complex tax evasion schemes. Using actual case examples culled from court records and public information, this presentation will provide analysts and investigators with red flags and indicators, as well as potential sources of information, in these complex and fascinating investigations.

Learning Objectives:  At the end of the presentation, the participant will be able to:

  • Identify how criminals and fraudsters move money, funds, and assets to offshore locations to avoid confiscation or detection;
  • Apply the investigative strategies to foreign financial investigations and asset recovery;
  • Identify how offshore trusts, shell companies, and other entities are utilized to conceal funds;
  • Apply case studies to scenarios for investigating complex foreign financial cases.

 

GAO’s Recent Work on Fraud Risk Management, Including in the Unemployment Insurance System

Presenter: Lauren Kirkpatrick (GAO) and Erin Villas (GAO)

Since 2015, GAO has issued over 70 reports with numerous recommendations to help federal agencies manage their fraud risks. In this session, we will discuss five areas identified in our prior work in which federal agencies need to take additional action to help ensure they are effectively managing fraud risks.

Specifically, in April 2023 (GAO-23-106567, Fraud Risk Management: Key Areas for Federal Agency and Congressional Action), we reported that our prior work has shown that federal agencies need to take additional actions related to (1) designating an entity to lead fraud risk management, (2) assessing fraud risks, (3) designing and implementing an antifraud strategy, (4) using data analytics to manage fraud risks, and (5) managing fraud risks in emergencies. We will also highlight actions identified in our prior work that Congress can take to strengthen fraud risk management practices across the government. In addition, this session will highlight GAO’s recent work on Unemployment Insurance (UI) fraud during the pandemic. Specifically, in December 2022 (GAO-23-105523, Unemployment Insurance: DOL Needs to Address Substantial Pandemic UI Fraud and Reduce Persistent Risks), we reported that measures and estimates indicate substantial levels of fraud and potential fraud in UI during the pandemic. GAO estimated over $60 billion in fraudulent UI payments by extrapolating the lower bound of the Department of Labor's (DOL) 2021 estimated national fraud rate for the regular UI program. However, such an extrapolation has inherent limitations and should be interpreted with caution. In ongoing work, we are developing a more comprehensive estimate on the total extent of UI fraud during the pandemic.
  

As of January 2023, GAO has eight open recommendations to DOL to strengthen its management of UI fraud risks. Recommendations include considering options to prevent fraud in programs designed to help self-employed and contingent workers, designating an entity to manage fraud risks, performing fraud risk assessments, and developing and implementing an antifraud strategy.
